The Delhi High Court has repeatedly directed the Central Government as well as the Delhi Government to deport illegal migrants of Bangadeshi origin. It has even set a daily quota.
The problem is that if an illegal migrant is detected, his status has to be confirmed in accordance with law and he cannot be repatriated to the country of origin unless we have a deportation agreement with that country. Even in the absence of the agreement, a Government may accept a deportee, if his national status has been judicially determined but detection or suspicion and detention by police is no substitute for judicial determination.
Presently any person suspected to be an illegal resident is detained in special camps and then sent under police guard to the border where he is pushed to the other site. This process is a violation of international as well as humanitarian laws. We have to work out an agreement to deal with the suspected migrants from Bangladesh in a human manners after their status has been determined judicial on the basis of the available evidence, the Government through diplomatic channel should approach the Bangladesh Government for appropriate mode for his transfer.
The procedure should be placed before the High Court for endorsement.
